The general conditions of sale, set out below, are considered valid for any order received by Rocri S.r.l. through the online shopping site and are an essential part of each order.
Any changes to these clauses as well as any special conditions must be expressly agreed in writing.
By placing an order, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
The products of foreign brands do not always have the assembly and use instructions in Italian, while the products of Italian brands do not always have the assembly and use instructions in languages other than Italian, if interested, ask by email first of the purchase.
The images accompanying the description of a product may not be perfectly representative of its characteristics but differ in color, size, products and accessories shown in the figure.

The minimum amount of an order is 24.59 euros excluding VAT, plus shipping costs calculated by the cart in the purchase process.
Correct receipt of the order is confirmed by an e-mail reply, sent to the e-mail address supplied by the Customer.
Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.
For each order placed, a receipt will be issued contained in the package or invoice sent via PEC or SDI code, for the issuance of the invoice, the information provided by the Customer at the time of the order will be valid.
It is not possible to request an invoice after the receipt has been issued and no changes to the invoice will be possible after the issue of the same.
Orders are generally processed on the same working day of receipt of payment (before 12.00) or on the following working day.
Customers are advised to check the accuracy of the contact details provided during registration for the correct receipt of orders.
After the order has been shipped, it will not be possible to change the delivery details of the order.
Customers are advised to provide contact details where someone is always available for the delivery / acceptance of the order.
In the event of failure to collect the order, after the second failed delivery attempt, in the event of storage due to the impossibility of delivering the package, the order will be automatically canceled.
Rocri S.r.l reserves the right to deduct the costs of storage and management of the non-collected order from the value of the order with a minimum of 20.00 euros to fully cover the costs of storage and management of the non-collected order.
The goods travel at the risk and peril of the buyer, who, in his own interest, must check the integrity of the packages before collection including packaging materials such as tape and metal straps and the quantity of goods received.

Normally, for the main Italian locations, excluding islands and disadvantaged locations, delivery takes place the working day following shipment, otherwise in 2-3 working days.
For shipments to Europe and the rest of the world, delivery takes 3-7 working days depending on the location.
The delivery terms are purely indicative and have no contractual value.

All prices indicated are VAT INCLUDED for customers whose shipment takes place in a European country. For customers from the rest of the world and for European companies, VAT EXCLUDING will be calculated by accessing the corresponding portal based on the registration information.
Rocri S.r.l. reserves the unquestionable right to make changes to the published prices if necessary.
The prices of items sold online may differ from the prices of the same items in store.
RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form a reference to VAT number), he right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the next point.
To exercise this right, the customer must send Rocri S.r.l. a communication to this effect, within 14 working days from the date of receipt of the goods.
This communication must be sent by registered letter with acknowledgment of receipt, addressed to: Rocri S.r.l. Via Bari 2 00161 Rome, Italy.
Once the notice of withdrawal has been received, Rocri S.r.l. will provide to communicate to the customer the instructions on how to return the goods that must be sent to Rocri S.r.l. within 14 days of authorization. The right of withdrawal is subject to the following conditions: the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, attachments, etc ...); the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, insert it in a second box; in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided;
by law, the shipping costs for returning the goods are charged to the customer;
the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
in case of damage to the goods during transport, Rocri S.r.l. will notify the customer of the incident within 5 working days of receipt of the goods in their warehouses, to allow him to file a complaint against the courier of his choice and obtain a refund of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal;
Rocri S.r.l. is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport.
The right of withdrawal is totally lost, for lack of the essential integrity of the goods (packaging and / or its contents), in cases where Rocri S.r.l. make sure: the lack or damage of the external packaging and / or the original internal packaging; the absence of integral elements of the product (accessories, cables, manuals, parts, ...); damage to the product; the lack of tax documentation.
In case of forfeiture of the right of withdrawal, Rocri S.r.l. will return the purchased good to the sender, charging the shipping costs to the sender.
Without prejudice to the points mentioned above Rocri S.r.l. will refund the customer the amount of the goods purchased, by bank transfer / paypal / credit cards.
In the case of a bank transfer, it will be the customer's responsibility to provide the bank details on which to obtain the reimbursement (ABI code - CAB - current account of the holder).
RETURNS AND COMPLAINTS
Any disputes must be sent in writing to Rocri S.r.l. within 7 days of receipt of the goods.
The return of the goods must be authorized in advance by email.
Authorized returns must be sent to Rocri S.r.l. warehouses, accompanied by original packaging including instructions and receipt or tax document.
Once the defect has been verified, if attributable to the product, the goods will be replaced.
At the sole discretion of Rocri S.r.l. in the event of unavailability, the goods may be replaced with other goods of equal or greater value or the purchase price of the goods re-credited.
If the malfunction or breakage is attributable to the buyer due to misuse of the product or tampering and wear, the product will be returned to the buyer who will pay the shipping costs and nothing will be owed by Rocri S.r.l. to the buyer.
All shipping costs for returns, shipments and shipments are the responsibility of the buyer.
You can pay through the online payment system with credit cards, debit cards, paypal and bank transfer.
OWNERSHIP OF THE GOODS
Rocri S.r.l. remains the owner of the goods until full payment of the same by the customer.
Rocri S.r.l. cannot be held responsible for any inaccuracies found in the technical characteristics or information of the product sheets on the rocrimodellismo.com website and therefore assumes no responsibility for any damage received or caused in the use of the products themselves.
Each image, document, software, card, present on the rocrimodellismo.com website can be modified or removed at any time and without notice.
All products sold by Rocri S.r.l. they are covered by the manufacturer's conventional warranty and by the 24 month warranty for lack of conformity, pursuant to Legislative Decree 24/02.
To use the warranty, the Customer must keep the invoice / receipt and the packaging of the goods.
The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging.
The 24 month warranty pursuant to Legislative Decree 24/02 applies to products with a lack of conformity, provided that the product itself has been used correctly, in compliance with its intended use and as provided in the attached technical documentation.
This guarantee is reserved for private consumers (individuals who purchase goods for purposes not related to their professional activity, or make the purchase without indicating a VAT number in the order form).
In case of lack of conformity, Rocri S.r.l. will restore the conformity of the product by repairing / replacing or reducing the price, until the contract is terminated.
If, following intervention by a supplier, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for the verification and restoration costs requested by the supplier, as well as transport costs.
In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, Rocri S.r.l. may proceed at its discretion to refund the amount paid for the product or to replace it with a product of equal or superior characteristics.
No damage can be requested from Rocri S.r.l. for any delays in carrying out repairs or replacements.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, insert it in a second box; in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided.
For any eventual controversy, the Court of Rome is considered competent.
